Acceptable Use Policy

The CartChat WhatsApp Broadcast Service exists solely to facilitate lawful, commercial business communication. It may never be used for political, ideological, or advocacy purposes, nor for any message that infringes on the rights of others. Every broadcast order is reviewed by our team before approval, and violations result in immediate order rejection and may result in account suspension.

1. Purpose of This Policy

This Acceptable Use Policy ("AUP") governs all use of the CartChat Broadcast Service, including any mailing list provided by CartChat ("house lists") or submitted by you ("customer lists"). By submitting a broadcast order, you agree to comply fully with this policy.

2. Permitted Use

The Broadcast Service may be used exclusively for legitimate commercial business communication. Examples of permitted content include:

Product launches, promotions, and sales announcements

Order, shipping, and service updates

Event invitations (commercial, corporate, or retail events)

B2B partnership, pricing, or catalog communications

Loyalty programs and customer retention messaging

3. Prohibited Use

You may not use the Broadcast Service, any house list, or any customer-submitted list for:

Political campaigning, candidate promotion, or election-related messaging of any kind

Advocacy, lobbying, or ideological/religious persuasion campaigns

Content that infringes on any third party's intellectual property, trademark, or copyright

Content that violates any individual's privacy or publicity rights

Harassment, hate speech, discriminatory, or defamatory content

Misleading, fraudulent, or deceptive commercial claims

Unlawful goods or services (e.g. controlled substances, counterfeit products, weapons)

Any message sent to a list whose contacts did not consent to commercial communication

4. Responsibility for Submitted Lists

If you submit your own contact list, you confirm and warrant that:

You lawfully obtained every contact in the list (e.g. through your own customer relationships, opt-in forms, or legitimate business dealings).
Recipients have a reasonable expectation of receiving commercial communication from you specifically.
You have not purchased, scraped, or otherwise acquired the list through unlawful or unauthorized means.
You will honor any opt-out or unsubscribe request promptly.

CartChat reserves the right to request evidence of consent or lawful basis for any submitted list prior to approval.

5. Use of House Lists

House lists (segments owned and managed by CartChat) are licensed to you for a single approved broadcast use only. You may not export, resell, copy, or reuse house list contacts outside of the approved CartChat broadcast order.

6. Review & Approval Process

Every broadcast order — message content and list — is reviewed by our admin team before approval. We reserve the right to reject any order, request edits, or decline service at our sole discretion if content appears to violate this policy, regardless of payment status.

7. Consequences of Violation

Violation of this policy may result in: immediate rejection of the broadcast order, withholding or refund of payment at our discretion, suspension or termination of your CartChat account, and reporting to relevant authorities where required by law.

8. Your Acknowledgment of Responsibility

You acknowledge that you, the customer, bear full legal responsibility for the content of any message you submit and the lawfulness of any list you provide. CartChat's review process is a quality and compliance check, not a substitute for your own legal responsibility to comply with applicable consumer protection, data privacy, and anti-spam laws in your jurisdiction.

By submitting a broadcast order through CartChat, you confirm that you have read, understood, and agree to this Acceptable Use Policy, and that your message and list comply with all sections above. This policy works alongside our Terms of Service and Privacy Policy.
